Terms of Service

These terms govern your use of Lapid Rides as a driver or passenger in Zambia. Please read carefully before using the platform.

Introduction

Welcome to Lapid Rides ("the App"), a ride-sharing and delivery platform operating in Zambia. By registering and using this App — whether as a driver or a passenger — you agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you and Lapid Rides ("Lapid", "we", "our", "us"). If you do not agree, please do not use the App.

Eligibility

To use Lapid Rides, you must:

  • Be at least 18 years of age.
  • Drivers: Hold a valid Zambian driver's licence appropriate for your vehicle category.
  • Drivers: Own or have lawful possession of a roadworthy, insured vehicle.
  • Drivers: Pass Lapid's document and background verification process.
  • Provide accurate, current, and complete registration information.

Driver Obligations

As a Lapid Rides driver, you agree to:

  • Maintain your vehicle in a safe, clean, and roadworthy condition at all times.
  • Comply with all applicable Zambian traffic laws, the Road Traffic Act, and local authority regulations.
  • Treat all passengers and delivery customers with professionalism and respect.
  • Never drive under the influence of alcohol, drugs, or any impairing substance.
  • Complete accepted trips and delivery requests promptly and to the best of your ability.
  • Not discriminate against any user based on race, gender, disability, religion, or any protected characteristic.
  • Maintain the minimum driver rating required by Lapid's quality standards.

Rides & Delivery Services

Lapid Rides is a technology platform connecting drivers with passengers and customers. You acknowledge that:

  • Lapid acts as a technology intermediary, not a transport or delivery operator.
  • Drivers are independent contractors, not employees of Lapid Rides.
  • Drivers are free to choose their working hours and are not obligated to accept any specific request.
  • Excessive cancellations of accepted requests may result in account suspension.
  • Lapid may set minimum service standards that drivers must maintain to continue using the platform.

Earnings & Payments

  • Fares are calculated by the Lapid platform based on distance, time, demand, and applicable promotions.
  • Lapid charges a service fee (commission) communicated through the App, which may be updated from time to time.
  • Payments are processed via approved methods including MTN Mobile Money, Airtel Money, Zamtel Kwacha, and bank transfer.
  • Earning disputes must be raised with Lapid support within 7 days of the disputed transaction.

Safety & Conduct

Safety is Lapid's highest priority. All users agree to:

  • Report any accidents, incidents, or safety concerns to Lapid immediately through the App.
  • Not solicit additional payment beyond the fare shown in the App.
  • Not record other users without their explicit consent.
  • Cooperate fully with Lapid's investigations of complaints or incidents.
  • Not engage in fraudulent activity, including fare manipulation or creating fake trips.

Lapid reserves the right to deactivate any account immediately for serious safety violations.

Intellectual Property

The Lapid Rides App — including its design, features, logos, and content — is the intellectual property of Lapid Rides. You are granted a limited, non-exclusive, non-transferable licence to use the App solely for its intended purposes. You may not copy, modify, distribute, or reverse-engineer any part of the App.

Account Suspension & Termination

Lapid may suspend or terminate your account for:

  • Violation of these Terms.
  • Serious safety incidents or verified complaints.
  • Fraudulent or deceptive activity.
  • Failure to maintain required documents or vehicle standards.
  • Extended periods of inactivity.

Any outstanding earnings owed to a terminated driver will be processed within 14 business days.

Limitation of Liability

To the maximum extent permitted by Zambian law, Lapid shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Lapid's total liability shall not exceed the earnings or payments processed through the App in the 30 days preceding any claim.

Governing Law

These Terms are governed by the laws of the Republic of Zambia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zambia. Lapid encourages amicable resolution before pursuing legal action.

Changes to Terms

Lapid may update these Terms from time to time. You will be notified of material changes through the App. Continued use of the App after notification constitutes acceptance of the updated Terms.

Privacy Policy

This policy explains how Lapid Rides collects, uses, stores, and protects your personal information in Zambia.

Lapid Rides ("Lapid", "we", "our") is committed to protecting your privacy. This Privacy Policy explains how we handle your personal information when you use the Lapid Rides platform in Zambia.

This policy complies with the Data Protection Act No. 3 of 2021 of Zambia and applicable international data protection principles.

Information We Collect

Identity & Contact Information

  • Full name, date of birth, national ID or passport number.
  • Phone number and email address.
  • Profile photograph.

Driver & Vehicle Documents

  • Zambian driver's licence details.
  • Vehicle registration and roadworthiness certificate.
  • Motor vehicle insurance documents.

Location Data

  • Real-time GPS location when the App is active.
  • Trip and delivery route history.

Financial Information

  • Mobile money account details or bank account information.
  • Transaction and earnings history.

Usage Data

  • App usage patterns, device information, and crash reports.
  • Driver and passenger ratings and feedback.

How We Use Your Information

  • Verify your identity and eligibility as a driver or passenger.
  • Match drivers with passengers and delivery customers.
  • Process payments and driver earnings.
  • Provide customer support and resolve disputes.
  • Improve the safety and quality of our services.
  • Send service-related communications and updates.
  • Comply with legal and regulatory obligations in Zambia.
  • Detect and prevent fraud and abuse on the platform.

Location Data

Location tracking is fundamental to Lapid Rides' functionality. When the App is active:

  • Your real-time location is shared with matched passengers or customers during active trips/deliveries.
  • Your general location may be visible to nearby users seeking rides or deliveries.
  • Location history is retained for 12 months for safety and dispute resolution.

You can control location permissions through your device settings, but disabling location access will prevent use of the App's core services.

Sharing Your Information

We may share your information with:

  • Passengers & Customers: Your name, photo, vehicle details, and live location during active trips.
  • Payment Processors: Mobile money and banking partners to facilitate payments.
  • Regulatory Authorities: Zambia Police Service, RTSA, or other government bodies when required by law.
  • Safety Investigations: Third parties assisting with incident investigations.
  • Service Providers: Technology and cloud infrastructure partners bound by confidentiality obligations.

We do not sell your personal information to third parties for marketing purposes.

Data Retention

  • Account & Identity Data: 5 years after account closure.
  • Trip & Delivery Records: 3 years.
  • Financial Transaction Records: 7 years (as required by Zambian tax law).
  • Location History: 12 months.

You may request deletion of your personal data, subject to our legal retention obligations.

Data Security

We implement appropriate technical and organisational measures to protect your data, including:

  • Encrypted data transmission using industry-standard protocols.
  • Secure cloud storage with restricted access controls.
  • Regular security audits and vulnerability assessments.
  • Staff training on data protection obligations.

You are responsible for keeping your App login credentials confidential.

Under the Zambia Data Protection Act No. 3 of 2021, you have the right to:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate or incomplete data.
  • Deletion: Request deletion of your data, subject to legal retention requirements.
  • Objection: Object to the processing of your data in certain circumstances.
  • Portability: Request your data in a machine-readable format.

Children's Privacy

Lapid Rides is not intended for use by individuals under 18 years of age. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected such information, please contact us immediately.
